根本违约是国际货物买卖中的一项重要规则.1980年的<联合国国际货物销售合同公约>吸收了英美法的成果采纳了这一制度,其有关条款成为国际货物买卖中判断当事人一方是否构成根本违约以及能否解除合同的重要标准,是当今国际贸易交往中得到广泛适用的一项规则.我国应当积极借鉴根本违约制度,进一步完善我国合同立法.
