合同诈骗罪几个疑难问题的探讨

合同诈骗罪是从普通诈骗罪分离出来的经济犯罪,本文对司法实践中该罪的几个疑难问题进行了剖析,明确了合同诈骗罪的合同应是进行市场交易的一种民事法律行为;探讨了“以非法占有为目的”的认定;借鉴单位人格否认之理论,指出对于个人假借真实存在的单位名义进行合同诈骗的行为,实为个人行为,应以个人犯罪论处。     

合同诈骗罪中若干问题的司法认定

合同诈骗罪中的合同形式应包括书面形式和口头形式.非法占有目的要通过客观行为来推断,坚持主客观相一致的原则.合同诈骗罪的数额应当以被害人的实际损失额为认定标准.“连环合同诈骗罪”的数额认定以受骗单位或者个人的实际损失额为认定标准.未完成犯罪形态下,合同标的额可以作为犯罪数额.

合同诈骗罪是指以非法占有为目的,在签订、履行合同过程中骗取对方当事人数额较大财物的行为。本文从合同诈骗罪的犯罪构成和合同诈骗罪数额的认定两个方面进行阐述。

合同诈骗罪主观目的探析

合同诈骗罪的实质是在非法占有目的支配下设定骗局无偿攫取他人财物。非法占有目的较之诈骗手段,因没有明确、具体的立法判定标准,其准确判定成为认定合同诈骗罪的难点。司法实践中,正确运用刑事推定规则,综合分析行为人特定的诈骗手段、方法等客观因素,推定其具有非法占有的主观目的性,对合同诈骗罪的成立不仅合理而且必要。     

论贷款诈骗罪主体

我国刑法把单位排除在贷款诈骗罪的犯罪主体之外是立法的明显漏洞。也不符合司法实践的需要。事实上，诈骗罪与其所派生的金融诈骗、合同诈骗、贷款诈骗等犯罪是种属关系。它们之间存在法条竞合的情形，而合同诈骗罪与贷款诈骗罪并列同属诈骗罪的特殊法条。因此。在刑法修改之前，对单位贷款诈骗行为应依法以贷款诈骗罪追究有关直接负责的主管人员和其他责任人员的刑事责任。当然，在量刑时要体现原则性与灵活性相结合的原则。     

论新刑法中的信用证犯罪

笔者结合信用证运作特点,对此罪的表现形式及其认定作了分析,认为该罪是行为犯罪,并以“数额较大”、“情节严重”作为判断罪与非罪的标准,其与诈骗罪、合同诈骗罪、贷款诈骗罪亦有明显不同。在定罪与量刑时亦要充分考虑到其多为牵连犯罪或共同犯罪的特点。     

信用卡诈骗罪中对"恶意透支"的理解

信用卡诈骗罪是一种较为新型的金融诈骗犯罪。恶意透支是信用卡诈骗罪的一种具体表现形式。但在认定“恶意透支”的问题上有不同的认识。本对“恶意透支”的行为内涵进行较为细致的分析，以便能准确地把握恶意透支型的信用卡诈骗罪的认定问题。

1979年修订后的新《刑法》在诈骗罪之外又设了合同诈骗罪，将其从诈骗罪中抽出作为一个单独的罪名，并不再置于侵犯财产罪的章节中，而是置于破坏社会主义市场秩序罪章节中。新《刑法》实施多年来，合同诈骗罪一直是立法者十分关注的问题。
