| 摘 要： | 正义的多重属性使普遍正义与个别正义经常发生冲突,代表普遍正义的法律应用到某些特殊案件会出现普遍正义抹杀个别正义的情形,产生不公正的审判结果。本着人本主义精神立法和实行真正的自由裁量有助于纠正法律的偏差,从法律源头和审判过程减少普遍正义与个别正义的冲突。

| Abstract: | General justice and specific justice often conflict each other under the mulriple character of justice,the general justice will eliminate specific justice and result injustice while the law apply to some special cases. If the legislation can consider some humanitarian factors and the justice take freedom-trial,it should administer to remedy the distorting law and reduce conflict between general justice and specific justice. |
