| 摘 要： | 竞技体育是具有特殊性规范的社会活动领域.目前却因为赌球、黑哨、斗殴、兴奋剂、竞技伤害、运动员年龄欺诈、控制比赛结果、体育彩票做假等事件的不断增加,导致了与竞技体育相关的社会秩序、市场秩序、赛场秩序的混乱和失控.有鉴于此,应该合理调配法律资源,运用刑法的观念和方法来寻求应有的"秩序",以实现竞技体育秩序之应然价值的最大化.

| Abstract: | Athletic sports are a social arena with its unique norm.At present,constant increase in the incidents of football gambling,black whistle,fighting,doping,competition injury,match manipulation and cheating in sports lottery leads to chaos in the social order,market order and match order related to athletic sports.In view of the fact,legal resources should be reasonably distributed and criminal law should be applied to seek the right order to realize the maximum value of athletic sports order. |
