未成年人前科消灭制度探析

前科作为一项有罪记录,会使行为人丧失一定的民事或行政上的权利、资格,对未成年人而言,前科对其生活以及回归社会的负面影响更为深远和严重。因此,无论从从实现刑罚目的的角度考虑,还是从保护未成年人这一特殊群体的需要出发,我国均有必要建立未成年人犯罪的前科消灭制度。
