摘    要:大学章程的功能实现是完善大学治理结构、提升大学治理能力、建设现代大学制度的关键内涵。当前大学章程实施中,行动者间的互动存在权力与权利失衡现象,即"强政府-弱学校"导致高校办学自主权行使受阻,"统一领导-全面负责"导致政治权力与行政权力界限不明,"重行政-轻学术"导致学术权力弱化,"大学校-小学院"导致学院办学自主权受制约,"泛行政-弱监督"导致师生权利保障不利,给大学章程的功能实现带来了消极影响。为此,应通过权力与权力以及权利对权力的制衡,推动章程实施中行动者的良性互动,提升大学章程的功能实现度。

Abstract:In the current implementation of university charter,the interaction between actors appears the imbalance of power and rights. There’re "strong government-weak school"leading to the obstruction of autonomy,"unified leadership-all-round responsibility"leading to the boundary between political power and administrative power,"heavy administration-light academic"leading to the weakening of academic power,"big school-small college"leading to the restriction of the autonomy,and "pan-administration-weak supervision"leading to the unfavorable protection of teachers and students’ rights,which has brought negative effects on the function realization of university charter. Therefore,balance between power and power and restriction of rights to power,could promote the benign interaction of the actors in the implementation of university charter and improve its function realization.
