从适用受阻现状反思我国反诉制度的完善

现行立法对反诉制度没有系统科学的具有操作性的规定。目前有关反诉制度的司法解释不仅不能适应现实司法实践的需要,而且一定程度上也导致了适用上的混乱。因此,应建立强制反诉制度。从强制反诉的主体,时间,审理和判决方式等方面提出完善的建议。

The improve of the counterclaim system in China

The existing legislation for the counterclaim system has no a system of science.The present judicial illustrate of the interpretations counterclaim system is not satisfied with the demand of the judicial practice,to some extent,also led to the confusion of the judicial practice.Therefore,we should establish a compulsory counterclaim system.The paper proposed the improving proposal about the main part,the time,the hear and the judge of the compulsory counterclaim.
