以十六大精神为指导,建立我国的司法独立运行机制

司法独立是现代国家司法制度中的基本特征和要求。我国现行宪法规定了司法独立制度，但现实中我国司法独立不尽如人意。党的十六大提出了司法改革的原则和目标，以十六大精神为指导，我国应该建立垂直的司法领导体制，完善国家权力之间的制约机制，深入司法机构内部的机制改革，在我国真正确立司法独立的运行机制。

Building a Functioning System of Judicial Independence in China Guided by the Spirit of the 16th National Congress of the CPC

Judicial independence is a fundamental characteristic and a requirement in the modern judicial system. The judicial independence system is provided in our constitution, yet is not satisfying in reality. The principle and the object are put forward in the 16th national congress of the CPC. Guided by the spirit of the 16th NCNPC, our country should establish a vertical judicial leading system, improve a restrict mechanism of the national power, and go deep into the inter judicial mechanism innovation to establish a real judicial moving mechanism in our country.
