| 摘 要： | 司法独立是法治的不可缺少的必要条件，在我国，由于法院管理体制的不尽合理，法院与党、人大、行政机关的关系未理顺等原因，司法难以真正实现独立。为保障司法独立，必须更新观念、改革制度和健全机制。

| Abstract: | Judicial independence is of necessity in the legal system. In China, due to the unreasonable manage system and the unsmooth relationship between the court, the party, the People's committee and the administrative sections, judicature has no independence. Therefore we must innovate our concept, reform our system and perfect our mechanism. |
