对抢劫罪加重处罚情节中"入户抢劫"的理解

入户抢劫是严重侵犯公民财产权利和人身权利的犯罪行为,修订后的刑法将其明确地列入为抢劫罪的加重处罚情形。但在司法实践中以及刑法理论上对入户抢劫的认定存在一些争议。文章仅就对“入户抢劫”中的“户”的界定以及行为过程中的故意的转变等问题,提出了笔者的一些想法。

Comprehension of The "Enter - Household- Robbing" in the Increasing - Punishment - Details of The Robbery

Enter-Household- Robbing" is a criminal offence which seriously invades citizens property rights and personal rights, the revised criminal code explicitly list it in increasing - punishment - details of the robbery. But in the judicial practice and the criminal law theory, there are lots of disputes on defining "enter - household - robbing". Only aiming at defining "household" in the "enter-household - robbing" and the transformation of intension in the action process, this article brings forward some viewpoints.
