摘    要:模拟法庭是法学专业核心实践课程之一,各法律院校法学专业无一例外开设了该课程。但在模拟法庭教学中凸显出忽视庭前准备环节教学、模拟教学案例不典型、模拟角色“表演”成分过重、模拟庭审重程序轻实体、庭审场所、标志、言行欠规范等问题,致使模拟法庭的教学效果不理想。加强庭前准备教学指导,精选模拟教学案例,程序实体并重,教师担任模拟角色与学生共同模拟庭审;规范庭审布置、着装、庭审言行,加大模拟法硬件建设投入,是改进模拟法庭教学、实现模拟法庭教学功能价值的有效途径。

The Problems and Solutions to Moot Court Teachiong

Abstract:Moot court is one of the core curriculum for law school students. Almost without exception,every university which has the law school would set this course. However, practices in the moot court teaching highlights some problems:neglect the teach- ing of pre trial procedure;the cases chosen are not typical;the simulation of the roles is too dramatic;pay too much attention to the form instead of the real essencelthe trial place,signals and words are nonstandard,etc. Thus the teaching effect is not ide- al. To improve the moot court teaching and realize the value of its function, the most effective way is to reinforce the pre trial procedure, carefully select the cases, pay equal attention to the form and essence, encourage teachers participate into the simula- tion with students, scandalize the trial arrangement, clothing, words and behaviors, and increase the investment in moot court e- quipment.
