近年来,虚假诉讼呈多发趋势。这种行为侵害其他民事主体的合法权益,扰乱诉讼秩序,损害司法公正和权威。但学界和司法实务界对虚假诉讼的认识并不一致,各地司法机关对虚假诉讼行为的处理也无法统一。首先对虚假诉讼的概念作了辨析,然后从经济学及法经济学的角度,对虚假诉讼现象进行实证和规范分析,并探讨虚假诉讼行为的经济学原因,在此基础上提出三个方面的对策和建议。
