教育惩戒规章的合法性分析

摘    要:中小学教育实践中存在的不敢惩戒和滥用惩戒的双重乱象使得有必要制定教育惩戒规章。教育惩戒权的性质要求它在法律层面须具有依据,且不得抵触上位法。从《中华人民共和国教师法》的第7条、第8条,以及《中华人民共和国教育法》第44条的规定来看,立法者对教育惩戒权持认可的态度。为确保教育惩戒活动的合法性,教育惩戒规章在实施原则、惩戒的范围、惩戒的方式、惩戒的程序和纠纷解决等五个方面都不得抵触上位法。

Abstract:The double chaos of daring not to discipline and abuse of discipline in the practice of elementary and middle school education makes it necessary to formulate educational disciplinary regulations. The nature of educational disciplinary power requires it to have a basis at the legal level and must not conflict with the higher-level laws. Judging from the provisions of Articles 7 and 8 of the Teachers Law and Article 44 of the Education Law, legislators have a recognized attitude towards the educational disciplinary power. In order to ensure the legality of educational disciplinary activities, educational disciplinary regulations must not conflict with the higher-level laws in five aspects: the principles of implementation, the scope of disciplinary action, the method of disciplinary action, the procedure of disciplinary action and dispute resolution.
