民间金融破局之路在于鼓励地方立法创新

民间金融是一个国家金融体系中客观存在的组成部分,具有不可替代性,需要放开民间借贷,留给市场足够的自决空间,行政权力不要过分干预。民间借贷只是民间金融的一种形式,解决民间借贷纠纷和中小企业贷款难,不能仅仅考虑民间借贷的规范,还要考虑整个民间金融运行机制的完善。民间金融的法律规制,不等于要制定统一的法律,可以鼓励各地地方政府制定适合当地的一些地方性规则。民间金融问题的解决出路在于金融改革与创新,即转变观念、改革金融运行机制,主要是破除金融垄断,目标是形成多元覆盖的金融服务体系。

How to develop non-governement finance is always a confused problem in theory and practice.Nongovernment finance is an objective existence of the national financial system,which is also an unsubstitutable part of it.It needs to open up private loans,give enough self-determinative space to the market and can not be overinterfered by administrative power.Private loans are just one form of non-government finance.Resolving private lending disputes and small and medium enterprise loan difficulty can not only consider the standardization of private loans,but also need to consider the improvement of the operating mechanism of the whole non-government finance.Statutory regulation on nongovernment finance does not mean to formulate a unified law,and it can encourage local government to formulate some local regulations which meet the local situation.The way of solving the problem of non-government finance lies in the financial reform and innonvation,namely,to change idea,reform the financial operating mechanism,which is mainly to break the financial monopoly and the goal is to form the multiple coverage financial service system.
