产业集群视野下石油化工行业知识产权诉讼问题研究

我国石油化工行业以专利申报为主要保护技术的时候,国外石油大公司已调整科技战略,利用知识产权诉讼规则,限制甚至扼杀竞争对手,抢占国际市场优势。我国石油化工企业,不熟悉国际诉讼规则,尤其是在利用和防御知识产权诉讼方面,缺少群体诉讼合力,没有形成产业集群的诉讼策略,致使许多企业被逐出市场,失去了发展空间。认识发挥石油化工产业集群合力意义,分析我国石油化工产业知识产权诉讼中,涉外被控侵权案件多、诉讼费用大、专业性强、集群诉讼少的特点,提出我国石油化工产业集群知识产权的积极诉讼策略、防御诉讼策略及借鉴与保护诉讼策略。

On Intellectual Property Litigation in the Petrochemical Industry From the Perspective of Industry Cluster

While the main means of protecting intellectual rights in petrochemical industry in our country（ China） is protesting potent applications,some big oil companies,in order to seize advantages in market,have started alert their strategy by using Intellectual Property Litigation and even restricting their rivals. By contraries,some domestic companies,due to lacking knowledge of international law,especially in the area of application related laws and self- defense,and having no systemic litigation strategies,has been weakening its ability of competition in the market. In this article,the significance of cluster cooperation will be recognized. It also analyzes some features of intellectual property litigation in Petrochemical industry. For example it often involves international issues; it demand high litigation costs; it is complicated and requires professional concern. The paper proposed three types of litigation strategies： active and initiative strategies,defensive strategies and protection strategies.
