宋代秘密宗教治理背后的法律调整

北宋时期的秘密宗教法禁政策,继承了唐律中＂造妖书妖言＂和五代敕令中＂夜聚晓散＂的规定,发展为＂夜聚晓散、传习妖教＂的罪名,并把禁止妖教的法令从地方法规上升为中央法规。方腊事件后,南宋政府在此基础上制定了＂吃菜事魔＂条法。宋政府对秘密宗教的法律治理,深刻反映了宋代官员的地方治理政策。

The Study on the Law of the Secret Religion in the Song Dynasty

In the Northern Song Dynasty,the policy that prohibited secret religious inherited ＂make Yaoshu and Yaoyan＂of Tang ruler and the order of the Five Dynasties imperial order：＂the night gathered the dawn to disperse＂.Then developed it to be the charge named ＂the night gathers the dawn to disperse,to transmit the monster taught＂,and the law which prohibitied monster developed from the place laws to the central laws.In this foundation,the Southern Song Dynasty government drew up the law called ＂Chi Cai Shi Mo＂.The Song government＇s law enforcement on secret religion reflected its changes of law towards regional management.
