随着贸易全球化和高新技术的迅猛发展,采用专利标准占领全球市场已成为大势所趋。标准确立后通过专利联盟推行技术标准,获取经济利益则是企业普遍采用的重要手段。比较分析了DVD和MPEG标准下专利联盟的形成模式和特点,提出我国企业应当积极推进专利标准化建设,构建专利联盟的防护墙,提高企业的核心竞争力,规避国外技术壁垒以及知识产权壁垒的建议。

Comparative study on the formation pattern of patent pools under the trend of patent standardization——DVD mode VS MPEG mode

With the globalization of trade and the rapid development of high-tech,occupying the global market with patent standards has become a global trend.As an important means,patent pools are adopted to implement technical standards and obtain economic benefits after standards have been established.This paper compares the formation patterns and characteristics between the DVD and the MPEG standard model,and puts forward that enterprises should actively promote the standardization of patents,build the fence of patent pools,improve the core competitiveness of enterprises,and circumvent barriers of foreign technical and intellectual property rights in China.
