| 摘 要： | 体育明星形象权是规制体育明星形象商业化开发利用的一项制度设计.究其法律属性而言,体育明星形象权是一项无形财产权.就如何有效规制这一无形财产权,学者们多有争议.但目前,在规制体育明星形象权时,知识产权制度这一“次优”选择仍然是当前可以采用的最佳制度设计.

| Abstract: | The image right oi sports stars is a system to restrict the commercial exploration of sports star image. The sports star image right is intangible. The scholars have controversial ideas about how to regulate this right. The paper proposes that the intellectual property right is still the most appropriate design for regulating the sports star image. |
