| 摘 要： | 针对如何通过法律救济途径有效惩治非法拆迁问题，主张通过对非法拆迁的法律界定和非法拆迁法律阻却的分析，提出了惩治非法拆迁顽疾的最有效法律救济是通过修复、重建以恢复原状。
