| 摘 要： | 我国刑事诉讼法中三类自诉案件的起诉模式，在司法实践运作中出现诸多困难，为了解决这些问题，有必要取消部分自诉案件，限制自诉权的范围，构建以公诉为原则自诉为例外的起诉模式，以顺应世界公诉为主流的起诉模式。

| Abstract: | There are many problems with the prosecution mode of three kinds of cases of private prosecution in the criminal procedure law of our country in practice. In order to solve these problems,it is necessary to cancel some cases of private prosecution and limit the range of private prosecution right,and construct the mode that regards private prosecution as exception and public prosecution as principle to the criminal case in our country, to comply with the prosecution mode of public prosecution as mainstream in the world. |
