| 摘 要： | 体育立法依据问题是我国体育立法工作的根本问题,直接决定着我国体育法律的稳定性和可期性的增强.体育立法主要包括内在根据、法律依据以及现实依据等3个方面,其中,保障体育权益与弘扬体育精神是体育立法的内在依据,宪法、立法法、体育法等上位法是我国体育立法的直接法律依据,社会政治经济文化的全面发展是我国体育立法的现实依据.

| Abstract: | In China,basis of sports legislation is the essential issue which determines the persistence and stability of sports law.The basis of sports legislation is composed of inner basis,legal basis and practical basis.Specifically,sports rights protection and sportsmanship development are the inner basis;the higher-level laws such as constitution,legislation law,sports law are the direct legal basis;the round development in economy,politics and culture is the practical basis of the sports legislation in China. |
