保守主义政治哲学与普通法传统

长期以来，中国法律近现代化的进程深受大陆法系国家的影响，而对普通法系的关注则相对不足，事实上，以和缓、平稳、渐进为主要特色的普通法系法律发展模式同样值得我们学习。值得注意的是，保守主义对普通法系法律传统的形成有着极为深远的影响；但与此同时，保守主义政治哲学与普通法传统之间不是一种单向的影响关系，而是存在一种积极的互动。

The Conservative Political Philosophy and the Common Law Traditions

Our law modernization has been influenced a lot by the continental law contries for a long time but we paid little attention to the common law countries. In fact,the common law development pattern can also benefit us greatly,which developed mildly,smoothly and gradually. This research tries to discuss the common law traditions from the point of view of conservative political philosophy and thinks that there are mutual influences between the conservative political philosophy and the common law traditions.
