| 摘 要： | 无权处分效力问题是长期困扰法学界的一个问题。由于涉及物权行为、债权行为等概念的区别及效力,理论上也一直存在纷争。而由于中国立法上物权法的不完善及理论上有关研究的不成熟,对这一理论问题更是未能解决。因此,对无权处分效力进行研究,对我国民法理论的完善、物权法的制定具有非常重要的意义。

| Abstract: | The issue of ex-right dispositive act effect is the problem that has being puzzled the laws sector.For there are different understandings of real right behaviour and credit right behaviour,so there has not gained a uniform conclusion of ex-right dispositive act effect in theory.As in China,the imperfection of real right law in lawmaking and immaturity of relevant research in theories about real right law,so we have not settled this issue.The research on ex-right dispositive act effect will be significant for the perfection of China's civil rights theory and the lawmaking of real right law. |
