| 摘 要： | 从我国现有赔偿制度入手,论述惩罚性赔偿制度的概念、要件,及争议,提出建立我国惩罚性赔偿制度的立法建议。期望通过该制度来弥补传统损害赔偿制度的不足,达到补偿受害人、惩罚加害人、遏制不法行为发生、营造良好的社会信用体系。
