我国特殊教育法律体系的现状与发展

摘    要:残疾人受教育权要得以实现,需要相关法律的保障。经过几十年的发展,我国针对残疾人的特殊教育法律体系已初步形成,但仍存在着立法理念陈旧、立法层次低、法律条文可操作性不强、法律规定不一致以及内容欠缺等问题。因此,需要在特殊教育法律的价值目标和基本原则的指导下,积极推进特殊教育立法,增强法律的可操作性,以此发展和完善特殊教育法律体系。

Abstract:The law is the fundamental guarantee of education right’s realization for people with disabilities.After decades of development,China’s special education legal system for people with disabilities has initially formed,but still exist some problems such as obsolete legal idea,low-level legislation,weak operability,inconsistent rules and lack of some details and other issues.Therefore,we should actively promote the special education legislation and enhance the operability of the law under the guidance of special education law’s value target and basic principles,and then the special education legal system can develop and become perfect.
