| 摘 要： | 物权请求权的性质如何认识和界定,直接关系到物权请求权制度的定位和物权请求权体系的架构。从请求权的内在底蕴、请求权与债权间的逻辑关联、物权请求权与请求权、物权之间的关系等层面和角度来看,物权请求权乃是一种附从于物权而又独立于债权的请求权。

| Abstract: | The understanding and definition of the nature of Property Request Right directly relates to the location of such system and the resulted structure. From the perspectives of the inner quality, the logic relation between request right and creditor＇s rights, the relationship between the Property Request Right and request right, and the property right, the Property Request Right is a kind of request right which is affiliated to the Property Right but independent from the creditor＇s right. |
