知识共享与著作权保护的平衡

互联网的飞速发展，使传播者和作品传播载体发生了巨大变化，传统著作权制度受到冲击。2006年《信息网络传播权保护条例》颁布，但并没有赋予新主流传播者利用作品的便利，而新主流传播者也缺乏作品资源渠道。因此网络环境下，一方面著作权极度膨胀；另一方面法律的不完善造成著作权侵权大量发生。如何调整著作权人、新主流传播者和作品使用者之间的关系，平衡三者之间的利益成为丞待解决的问题，也成为建设创新型国家的关键。

The Balance of Knowledge Sharing and Copyrights Protection

The rapid development of the Internet carries the great changes to the dissemination of works and also to the propagator, the traditional copyright system is facing tremendous challenge. In 2006, ＂Protection Act of Information Network Propagating Rght＂ enacted, but it didn＇t empower the mainstream disseminators with convenience, and the new mainstream disseminators lack the works resources channels. So in the network environment, on the one hand, the copyright extremely inflates, on the other hand, large scale infringement occurrs for the faultily of the copyright. How to adjust the relationship among copyright holders, the new mainstream disseminators and the users becomes a problem to be solved and the key to innovation-oriented.
