| 摘 要： | 随着网络技术的发展,＂人肉搜索＂逐渐风靡网络,这种新型搜索引擎可以更为便捷而专业地解决求助者的问题,方便公众日常生活。然而其中更受关注的身份确认型＂人肉搜索＂却因与当事人相关人身权利的冲突而备受争议。文章试图从宪法学角度,对身份确认型＂人肉搜索＂进行分析,明确其中言论自由权与隐私权等人身权利的冲突,从而对其进行合理规制,以期引导其进入良性发展轨道。
