现行不动产登记效力的反思

现行中国不动产登记采登记要件主义，且将登记作为部分债权合同的生效要件，加之登记机关的分散和登记信息资料的保密使不动产登记效力的价值目标无法实现。笔者主张区分物权变动的原因，对因市场交易引起的物权变动，采登记对抗主义辅之善意取得制度；对因非市场交易引起的物权变动则纳^适用除外，并建议统一登记机关和建立信息公开制度。
