| 摘 要： | 我国理论界对专利池的研究主要集中在形成机理和反垄断两个方面,长期以来忽视了专利池的治理结构研究.专利池实际上是介于市场与合同之间的混合制治理结构,日益呈现多元化趋势.在比较不同类型的专利池治理结构的基础上,分析了影响选择治理结构的主要因素,并提出相应的选择策略.
