| 摘 要： | 学者们对于接受义务教育是受教育者的权利还是其义务，有着不同的观点，在认识义务教育的法律性质方面存在着误区。从宪法学的基本理论和权利的特征来看，义务教育应属于权利的范畴，接受义务教育是适龄公民应当享有的一项基本权利。把接受义务教育当作公民的一项法律权利有利于义务教育的实施和公民权利的发展。

| Abstract: | Is ＂getting a compulsory education＂ children＇s right or obligation？ The answer is different to people in the academic circle. The reasons for this phenomenon are complicated. In fact, getting a compulsory education is children＇ s right. Right to education has the contribution to the social development. Only we regard the compulsory education as children＇s right, can the compulsory education system run smoothly and the human rights develop fast. |
