大数据时代政府信息公开中的个人信息保护

政府信息公开是大数据时代提高政府服务的必然选择,但政府信息公开也应承担保护公民隐私的责任。为了实现大数据时代政府信息公开中的个人信息保护,通过文献梳理以及整合政府公开的相关信息,分析政府信息公开的特点,探讨政府信息公开过程中侵犯个人信息的问题及其原因。结合我国的国情,从明确“保障人权”的宪法地位、完善平衡法益冲突体系、构建隐私风险评估机制、增强个人信息保护与维权意识四个方面探索完善政府信息公开中个人信息保护的路径。

Personal Information Protection in Government Information Disclosure in Era of Big Data

Government information disclosure is an inevitable choice to improve government services under the background of big data,but the government should also bear the responsibility of protecting citizens’privacy.In order to realize the protection of personal information in government information disclosure in the era of big data,this paper analyzes the characteristics of government information disclosure and discusses the problems and reasons of infringing personal information in the process of government information disclosure through literature combing and integrating the relevant information disclosed by the government.Combined with China’s national conditions,this paper explores the path to improve the protection of personal information in government information disclosure from four aspects:clarifying the constitutional status of“protecting human rights”,perfecting the system of balancing legal interest conflicts,constructing a privacy risk assessment mechanism,and enhancing the awareness of personal information protection and rights protection.
