城中村改造法律问题研究

目前，我国城中村改造工作存在的问题是城中村改造缺乏法律依据，城中村违章建筑严重、房屋产权不明晰，村民思想上对改造有很强的抵触情绪，农村基层组织及其体制难以发挥作用，城中村改造和社会保障很难统一进行。改造工作难以进行的原因是城中村土地权属的变更，城中村集体资产的处置，改造后农民利益的保护，各方利益的分配。对此，我国应尽快完善城中村改造的法律法规，加强宣传，努力消除农民的抵触情绪，拓宽资金筹措渠道，创新资金筹措方式，健全社会保障机制，强化服务，加强监督。
