美国职业体育薪金纠纷特别解决机制研究

摘    要:薪金纠纷是体育纠纷中最常见的一类纠纷,但美国四大体育联盟却采取了几种不同的方式解决此类纠纷。该文就美国职业体育联盟采取了哪些特别的薪金纠纷解决机制、为何不同的职业体育联盟对薪金纠纷会采取不同的纠纷解决机制、各类型的薪金纠纷特别解决机制的实际运作效果如何等问题进行探讨。研究认为,薪金纠纷特别解决机制的设立与该项目球员流动的限制程度密切相关,薪金仲裁是对球员流动自由限制过大时对球员利益的一种有效但非必须的保障措施,而底价仲裁相比其他类型的薪金仲裁更具优势。

Abstract:Salary dispute is the most common dispute in sports. There are several different salary dispute mechanisms in the four major sports leagues in the U.S. This paper tries to answer the following questions:what are the special salary dispute mechanisms in the four major sports leagues in the U.S? Why do the different sports leagues adopt different salary dispute mechanism; What are the actual operation effects of the different salary dispute mechanisms? It can be seen that the setting up of the special salary dispute mechanism is closely related to the mobility freedom of the player. The salary arbitration is the effective but nonessential right safeguards measurse for the player when the freedom of player's mobility is severely restricted, and the final offer arbitration is the better salary arbitration mechanism than the other salary arbitration.
