| 摘 要： | 抵押登记能产生对抗第三人之效力,对抵押权人及时实现自己的债权有着重要的意义。我国采用登记对抗主义与登记生效主义相结合的混合主义,可以根据抵押物的不同情况对抵押登记的效力提出不同的要求。

| Abstract: | The mortgage registry can produce the effectiveness in resisting the third party. It helps the mortgagee to achieve his own creditor’s right timely. In our country we adopt the mixed doctrine combining the registration resistance doctrine with the registration effectiveness doctrine. This makes it possible to make different demands on the effectiveness of the mortgage registry according to different cases of the gage. |
