| 摘 要： | 因债务人怠于行使其到期债权，对债权人造成损害的，债权人可以向人民法院请求以自己的名义代位行使债务人的债权，但该债权专属于债务人自身的除外。本文对该现行制度进行了探讨，以使其更完善、更科学。

| Abstract: | A creditor can apply people's court for the subrogation of the creditor's right in the name of the creditor if the creditor is damaged because the debtor is idle to perform the due creditor's rights, with the exception the creditor's right exclusively belongs to creditor. The author in this article discusses this system to improve it more scientifically. |
