| 摘 要： | 商标淡化理论突破了传统理论对驰名商标的保护范围,最大限度地维护了驰名商标的显著性和独创性,对驰名商标实施太过周密的保护并不适合我国国情,商标淡化保护也在实践中逐渐暴露出其弊端.因而,有必要对驰名商标反淡化保护进行限制,具体而言,就是要明确商标淡化的构成要件,并通过对要件的概括抬高反淡化保护的门槛.

| Abstract: | The theory of trademark dilution breaks through the bound of tradition theory about protecting of famous trademarks,which maintain the distinctiveness and identification of famous trademarks at its best.However,too much protecting which was given to famous trademark does not suit our country,and now the theory of trademark dilution is coming to exposure it disadvantages.Therefore,it is necessary to confine the practicing of the theory.The element of dilution should be defined,and the criterion of protecting should be heightened. |
