| 摘 要： | 海事保全措施是海事立法中的不可或缺的部分,能够及时有效地解决海事纠纷和保障海事请求人的合法权益.扣押船舶可以说海事保全措施的最典型,同时也是最有效的措施之一.而船舶活扣押则又是其中比较特殊的一种扣押方式.活扣押有其独特的优越性,但也有局限性.如何适用好活扣押,对于有效解决海事纠纷、推进海事制度有着重要的意义.

| Abstract: | Measures of security of maritime claim are indispensable in maritime legislation,which can settle maritime disputes and protect maritime applicant's legitimate rights and interests.detention of ship is one of not only the most typical measures,but also the most effective measures.As a special measure of detention,live detention of ship has unique advantage as well as limitation.How to use live detention of ship well is important to settle down maritime disputes effectively and improve maritime system. |
