博硕士学位论文发表状态及发表权初探

针对我国研究生学位论文收藏机构合理利用必须确认“博硕士学位论文是否已经发表作品”的问题，从学位授予的相关规定、图书情报档案机构的利用、对学位论文的整理报道等方面论述分析得出：在相关的图书馆、情报机构、挡案馆上架后，学位论文应该处于已发表状态。鉴于学位论文作品的特殊性及我国著作权法合理使用条件的严格，建议博硕士学位论文著作权人的发表权应受到限制。

Analysis on the Published Status and the Right of Publication of Theses and Dissertations in China

According to Copyright Law of China, the works are published or not is the first judgment criterion on fair use of theses and dissertations in collecting institutions. Published status of theses and dissertations in collecting institutions was analyzed in three aspects, such as the relevant laws and law regulations about the awarding of the degree, the practical use in the relevant libraries, intelligence agencies and archives, the propaganda to them. The conclusion is arrived that theses and dissertations are made public while they are on the shelves in collecting institutions. An advice that the right of publication of them should be limited.
