| 摘 要： | 无讼思想在中国传统法律文化的价值取向中占据重要地位,它蕴含了我国古代对和谐社会的一种价值追求。胡锦涛同志在十七大报告中提出了"建设民主法治,公平正义,诚信友爱,充满活力,安定有序,人与自然和谐相处的社会主义和谐社会"的宏伟目标。为实现这一宏伟目标,我们这必须重视借鉴传统无讼思想在中国传统文化中的特殊意义。
