论国家精神损害赔偿金的相关标准——《中华人民共和国国家赔偿法修改草案》第三十四条分析

<中华人民共和国国家赔偿法修改草案>第三十四条规定:造成严重后果的,应当支付相应的精神损害抚慰金.该规定扩大了精神损害赔偿范围,确立国家赔偿中精神损害金钱赔付方式.但规定模糊,计算标准不明确,欠缺操作性.立足于我国的立法及现实状况,文章认为将精神损害赔偿金标准定位为抚慰性标准,同时立法应明确具体量化标准规则,赔偿金额计算的具体量化规则的制定应受法治原则、平等原则拘束,或由全国人大常委会以法律解释的方式予以明确.
