大学制度的性质、结构及其形态多样化

从资源配置角度看，大学具有聚集高等教育资源的功能，大学制度是资源产权主体之间的契约集。广义上的大学制度包括大学法人制度和大学教育制度。本文所指的大学制度即大学法人制度，是关于大学财产的设立、责任承担中的责权利关系，其核心也就是大学的产权制度，是大学制度中的重要组成部分。本文从大学制度的基本属性出发，提出了大学制度的纵向两层结构和横向的三种形态，并对我国民办教育的属性、发展路径作了分析。
