在法社会学领域，民间法是相对于国家法而言的一种法律形态。民间法作为法律现象在中国早已有之，但作为一个独特的法律概念是西方法社会学理论中国化的产物，而作为法学研究的专门对象则是西方法学发展到一定阶段，即法社会学形成之后的事。不论从民间法理论在西方衍生、成长的历史分析，还是从其中国化的社会背景看，民间法的存在自有其法理依据、历史条件和现实社会基础。

Analysis of the folks law's legal theory and society base——Analyses from folk law's theoretical origin and development.

In the law-sociology realm,folks law is a kind of law comparative to the national law.The folks method as law phenomenon has already existed in China,but it is the outcome with Chinese characteristic of western sociology theories as a special law concept.However,as the specialized object of law research,it is the result which developed to a certain stage,that is,after the formation of the law-sociology.Either to analyses the history of folks law's origin and development in the west,or to analyses the background in China,the existence of folks law has its own legal theory,history term and realistic social basic.
