| 摘 要： | 合同诈骗罪,由于立法将其归类于刑法分则第三章破坏社会主义市场经济秩序罪而成为刑法理论界的研究热点。目前,司法界对于合同诈骗罪中的"合同"的内容、形式和犯罪数额等方面,无论是在理论研究还是在司法认定上都存在着争议。文章针对合同诈骗罪在司法认定中的疑难问题,结合相关学理进行分析。
