简论我国犯罪构成的改造

近年来,对我国传统四要件犯罪构成的质疑不断增多。其实,我国原有的犯罪构成符合犯罪认定的逻辑顺序,便于司法实践,在原有构成基础上的改造才是理想的选择。犯罪构成应维持现有顺序,坚持客观主义,去除非规范化倾向,将犯罪客体改造为犯罪对象。
