| 摘 要： | 单位行贿罪的主体复杂多样,包括一人公司、合伙企业、个人挂靠型企业、风险经营型企业、承 包企业等,这几种特殊的企业形式能否成为单位行贿罪的主体是该类犯罪定性的关键;"情节严重" 是该罪客观行为方式的共同构成要件;该罪与对公司、企业人员行贿罪、单位受贿罪之间存在刑罚 配置不协调的问题,应当通过完善刑事立法予以修正.
