检察机关开展公益诉讼的思考

由检察机关作为适格的诉讼主体开展公益诉讼在多数国家的司法实践中,能够有效地维护社会公共利益。这在我国的司法实践中,也有大胆的尝试。令人遗憾的是我国2012年《民事诉讼法》对于可以提起公益诉讼的主体资格只是作了宣示性的规定。虽然新修改实施的《消费者权益保护法》对于有关组织的概念进行了界定,但是对于有关机关的概念和内涵仍然缺乏法律依据。构建检察机关开展公益诉讼制度对于完善我国公益诉讼制度具有重要意义,能够更好地维护公共利益。

Thinking on the Procuratorial Organs to Carry Out the Public Interest Litigation

The procuratorial organs,as the lawsuit main body of eligibility,carry out the public interest litigation in the judicial practice in most countries,which is able to effectively maintain social public interest. In the judicial practice in our country,it is also a bold attempt. It＇s a pity that ＂ The Civil Procedure Law＂ in 2012 in our country only made some nominal provisions for the public interest litigation subject qualification to be filed. Although the new revision of the implementation of the ＂ the Protection of Consumers＇ Rights and Interests＂ has defined the concepts of the relevant organizations,but it is still lack of legal basis for the concepts and connotation of the relevant authorities.The construction of the procuratorial organs to carry out public interest litigation system is important for improving the public interest litigation system in our country,which can be better safeguard the public interest.
