| 摘 要： | 商主体是否具有独立性,直接关系到商法是否具有独立于民法的存在价值问题,而这一点对我国正在进行的民法典体系构建研究也具有十分重要的意义。商主体的独立价值昭示了商主体独立的必要性,而法律主体的共性及商主体的个性也表明商主体独立的可能性。

| Abstract: | Whether or not a commercial major body is independent has connection with the issue of whether or not the commerce law has the value of being independent of the civil law.It is of great significance to the building of a civil law system now being carried out in our country.The independence value of the commercial major body reveals the necessity of the commercial major body,and the commonness and individuality also demonstrates the possibility of the independence of the commercial major body. |
