“两高”《关于办理妨害预防、控制突发传染病疫情等灾害的刑事案件具体应用法律若干问题的解释》为惩治非典病毒携带者过失危害公共安全的犯罪提供了法律依据。对携带非典过失危害公共安全罪的认定,要严格依照本罪的特征区分罪与非罪的界限以及此罪与他罪的界限。犯罪行为人要依法承担刑事责任。理论上,我们还应探讨对本罪犯罪行为人可合理适用一些非刑罚方法来承担其应承担的刑事责任。

In identifying this crime we should distinguish guilt from non - guilt and this guilt from other kinds of guilt according to its characteristics. The crime committers have to take legal responsibility according to law. Theoretically, we should also inquire into some un - penal punishment that can be reasonably used to make the crime committers take their necessary legal responsibility.
