我国未成年人刑法典分立之我见

我国现行刑法典以对成年人犯罪既遂定罪量刑标准进行制定的条文适用于未成年人犯罪显失公允，难以实现刑法面前人人平等。本文从司法实践中的个案引发思考，阐述了从现行刑法典中分离独立出来的未成年入刑法典、实行未成年入刑法典与成年刑法典二元分立的必要性，进而分析了未成年人刑法典名称及若干法律制度设置的构想。
